ABOUT INSURANCE

Always require a Insurance Certificate from anyone doing work on your property. Home Owner Insurance  provides certain coverage during construction on your home. If you are building a new home, you will also need a Builders Risk policy to cover the home while under construction. Require anyone working on your project have  General  Liability coverage.

About Workers Compensation Insurance. Some companies may legally elect to not carry it which usually means anyone who works for the company is a independent contractor.. Since it is mainly for the companies benefit and not the client, having it is not essential to the home owner. Here are excerpts from the Unannotated Georgia Code:

As used in this chapter, the term:
(1) 'Board' means the State Board of Workers� Compensation.

(a) This chapter shall not apply to

any person, firm, or private corporation, including any public service corporation, that has regularly in service less than three employees in the same business within this state,

(e) A person or entity shall otherwise qualify as an independent contractor and not an employee if such person or entity meets all of the following criteria:
(1) Is a party to a contract, written or implied, which intends to create an independent contractor relationship;
(2) Has the right to exercise control over the time, manner, and method of the work to be performed; and
(3) Is paid on a set price per job or a per unit basis, rather than on a salary or hourly basis.

Tell the contractor to have a Certificate of Insurance sent to you FROM THE INSURANCE AGENCY with your name and address indicated as the Certificate Holder. All the contractor has to do is call their insurance agent and give them your name and address. NEVER accept anything else because there are many fake certificates around.

I require a subcontractor  have their Agent fax me a Certificate and follow up with the original sent by mail. The fax will usually indicate where it came from or I will call the Agency listed on the certificate for verification. Also make sure you do receive the original.
